Penalties for DUI Conviction in Idaho

A person found driving under the influence of alcohol in Idaho may be tried in a criminal proceeding. If convicted, the penalties depend on a number of factors, including age of the defendant, level of blood alcohol when driving, the number of prior convictions for DUI, whether children were present inside the vehicle during the intoxicated driving, and damage or injuries caused by the defendant.

For a first time offender, the punishment can be a fine of $1,000 along with an alcohol abuse evaluation and a suspended driver's license for a period of three to six months. First time offenders with a blood alcohol content of .20 or greater face a one year absolute license suspension, fine up to $2,000 and 10 days to one year in jail.

A first offense or second offense DUI results in a misdemeanor. A third offense, a second excessive DUI conviction, or a DUI involving serious bodily injury to a victim is a felony. Second offense DUI convictions or later DUI convictions require an interlocking device on your automobile to verify sobriety before starting your vehicle.

The maximum penalty can be a jail term of 10 years and a fine of $5,000, as well as the suspension of driver's license for up to 5 years.
