Daycare Fight Club

Workers at a New Jersey daycare have been accused of starting a sort of "fight club" among the children ages from 4 to 6 years old. They filmed the the incidents and shared them on various social media websites. Erica Kenny and Chanese White have been charged with child abuse.  Kenny is also facing a child endangerment charge. It seems as though none of the children involved had any serious injuries. Kenny and White were fired from the Daycare center when the allegations were made.

The pair have both pled "not guilty" to the charges against them. White is facing 18 months in prison, while Kenny is looking at 5 years in prison. Their next hearing is scheduled for October 15 in Superior Court.

Comments from Allen:  Many crimes and wrongs are difficult to prosecute, because there is no documentation of exactly what occurred.  In this case, the staged fights were done purely for pleasure.  One of the defendants showed someone what happened on Snapchat, and that short, 10 second video disappeared within seconds.  However, the temporary video was recorded by someone else, and this prosecution followed.

In this electronic age, you can assume that anything you transmit online is etched in stone, it will never disappear, because there is a record of it somewhere.

The daycare owner was apparently horrified that this happened at her daycare.  However, since these fights occurred at the daycare and were staged by employees of the daycare during times the children were entrusted to the daycare, there may be lawsuits coming against that daycare.  The daycare owners are doing a PR campaign at this time to assure all the parents their children are safe; however, the daycare is still subject to being sued.  Because the conduct of these two employees was intentional, the conduct may not be covered by a homeowner's policy or business policy; these generally cover only negligent conduct which results in a lawsuit.

This daycare has a lot to lose.

Man Framed by Prosecutor Released After 29 Years in Prison Seeking Lawsuit

19 year old, Charise Kamps, was found raped and strangled to death in her apartment in June 1980. Ralph Armstrong told the police that both of them were at the apartment alone doing cocaine before leaving to go see friends around 9:30 pm. Police said that they learned that Armstrong owed Kamp's boyfriend $400 and witnesses saw Armstrong handing Kamps money that night. However, the money was not found in the apartment, and Armstrong deposited $315 in his bank the next day.The defense argued that he got the money from his brother. One of the neighbors saw a lean, muscular man about 5 feet 5 inches tall with long, dark hair drive up to the apartment. Before the identification process, the police had the witness hypnotized. Various methods have been used in police interrogations to elicit a confession. By far the most popular method used for over seventy years is the Reid Technique. This interrogation method assumes guilty suspects can be identified from certain behavioral cues.
