Firefighter Blows Off 911 Call

A New Mexico firefighter was taken off duty, and eventually resigned, after it was found out that he told a 911 caller to "deal with it yourself".

Jaydon Chavez-Silver was shot during a party on June 26. Police have said that he was simply in the wrong place at the wrong time. The firefighter, Matthew Sanchez, was on the phone with Jaydon's friend. He asked if the victim was breathing. The caller got upset with the questions and the firefighter told her to deal with it herself. Chavez-Silver was taken to the hospital where he eventually succumbed to his injuries.

The Fire Chief has launched an internal investigation into the call. Everyone from the fire department is going to go through additional crisis training.

Chavez-Silver's shooter has not yet been found, and they haven't named any suspects.

Comments from Allen:
Two questions arise. First, could Sanchez be charged with a crime? The answer is probably "no."  His negligent conduct may have contributed to the death of Chavez-Silver, but in order to make him criminally responsible for the death, he would have needed to have been committing some crime, and the commission of that crime contributed to the boy's death.

Next, could he be sued civilly?  The answer is probably "yes."  Sanchez and the city could probably be sued for negligently responding to an emergency call.  The 911 emergency line is specifically set up to respond to life-and-death situations like the one described by the caller.  If expert testimony establishes the boy could have survived the injuries but for the failure of 911 to dispatch an ambulance with EMT's to the scene, there may be liability for the victim's death.
